Terms of Service

1. Acceptance

By creating a DroidFleet account, installing the agent, or otherwise using the service, you agree to these Terms. If you disagree, don't use the service.

2. Account

• You must be at least 18 (or the age of majority where you live).
• You're responsible for keeping your password and API keys secure. Notify us immediately of unauthorized access.
• One account per person. Multiple users within a paid workspace require Team or Enterprise plan.

3. Acceptable use

You may NOT use the service to:

• Install malware, spyware, or software that violates third-party rights.
• Test apps on devices you don't own or don't have permission to test on.
• Reverse-engineer or scrape the service for competitive purposes.
• Circumvent rate limits or quotas.
• Harass, defame, or target individuals.
• Resell the service without a written reseller agreement.

Violations terminate your account without refund.

4. Your content

You retain ownership of APKs, configurations, and content you upload. By uploading, you grant us a non-exclusive, worldwide, royalty-free license to store, transmit, and process that content solely to operate the service.

5. Pricing & billing

• Paid plans billed in advance, monthly or annually, via Stripe.
• Prices shown at signup apply for that subscription term.
• We may change prices with 30 days' notice; existing terms honored until renewal.
• 14-day money-back guarantee on new paid subscriptions. No refunds on renewals or partial months.

6. Cancellation

• Cancel any time from your account settings. Access continues until the end of the paid period.
• We may suspend or terminate for Terms violations (with reasonable notice except for fraud or urgent security risk).
• On termination, you have 30 days to export your data before permanent deletion.

7. Service availability

We target 99.5% monthly uptime for paid tiers. Free is best-effort. Maintenance announced 48h in advance when possible.

Service credits available for paid tiers when uptime falls below 99.5%:

• 99.0–99.5% — 10% credit
• 95.0–99.0% — 25% credit
• Below 95.0% — 50% credit

8. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We don't guarantee that test results are complete or accurate for every Android version, that the service is uninterrupted, or that third-party dependencies (FCM, Cloudflare, Stripe) remain available.

You are responsible for validating that DroidFleet's output matches your testing requirements before shipping software.

9. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability is limited to the greater of:

• Fees you paid in the 12 months preceding the claim, or
• $100 USD.

We are not liable for indirect, incidental, consequential, or special damages, including lost profits or data — except for our gross negligence or willful misconduct, or where applicable law prohibits such limits.

10. Indemnification

You agree to defend and indemnify us against any claim arising from your breach of these Terms, content you uploaded, or your use of the service to violate third-party rights.

11. Changes

Material changes communicated by email 30 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing law

Governed by Israeli law. Exclusive jurisdiction in the courts of Tel Aviv-Jaffa, except either party may seek injunctive relief in any competent court.

13. Misc

• Severability — if any provision is unenforceable, the rest stays in effect.
• Waiver — our failure to enforce isn't a waiver.
• Assignment — you may not assign without consent. We may assign in connection with a merger or sale of assets.
• Force majeure — neither party is liable for failures caused by circumstances beyond reasonable control.
